Terms & Conditions

These Terms govern your use of the Baobab Wines website. Please read them carefully. If you're a trade account, some of these sections (trade accounts, product info, brand assets) are particularly relevant to you.

Effective date: April 2026. Please review these Terms periodically — continued use of the Site after changes take effect means you accept the updated Terms.

1. Acceptance of terms

These Terms and Conditions ("Terms") govern your access to and use of the Baobab Wines website at baobabwines.com and any related subdomains, services, or materials we provide (collectively, the "Site"). By accessing or using the Site, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not access or use the Site.

We may update these Terms from time to time. Material changes will be reflected by updating the effective date at the top of this page. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.

2. Age verification and lawful use

This Site presents information about alcoholic beverages. You may only access or use the Site if you are at least 21 years of age and of legal drinking age in your jurisdiction. By using the Site, you represent that you meet this requirement.

The Site is intended for viewing in jurisdictions where the sale, promotion, and consumption of alcoholic beverages is lawful. It is your responsibility to comply with applicable laws in your state, country, and locality.

We do not sell alcohol directly to consumers through this Site. All product listings, tasting notes, awards, and related information are intended to inform trade professionals and interested consumers about the Baobab Wines portfolio. Retail purchases must be made through a licensed retailer in your state.

3. Trade accounts and business relationships

Baobab Wines operates as a licensed importer and distributor of wine from the Republic of South Africa into the United States. Our primary customers are state-licensed wholesalers, retailers, restaurants, and on-premise accounts ("Trade Accounts").

If you contact us through the Site regarding a trade inquiry (e.g. distribution partnership, wholesale purchase, trade tasting, portfolio menu request), you represent that you hold any licences required by your jurisdiction to purchase, sell, or serve alcoholic beverages, and that you will provide valid licence documentation upon request.

Nothing on the Site constitutes a binding offer to sell or ship wine. All sales are subject to a separate written agreement, applicable federal and state licensing requirements (including three-tier compliance in the United States), product availability, and our acceptance of your order.

4. Product information and availability

We make reasonable efforts to ensure that product descriptions, vintages, tasting notes, certifications, images, and award information on the Site are accurate and up to date. However, information may be superseded by new vintages, certifications may change, and allocations may shift. We do not warrant that all information is current, complete, or free from error.

Product availability varies by state and is subject to our distributor agreements, inventory levels, and regulatory approval. Listings on the Site do not guarantee that a given wine is available in your market.

Technical specifications (ABV, closure, aging, production volumes) are provided by producers and are correct to the best of our knowledge at the time of publication, but may be updated vintage to vintage.

5. Intellectual property

The Site, including its design, layout, text, photographs, graphics, logos, icons, videos, and compilation of content, is owned by or licensed to Baobab Wines and is protected by United States and international copyright, trademark, and other intellectual property laws.

"Baobab Wines", the Baobab Wines logo, and the stylised baobab tree device are trademarks of Baobab Wines. Producer names, wine brand names, and producer logos shown on the Site are trademarks of their respective owners and are used with permission or under fair use for the purpose of describing the portfolio we import.

You may view, download, and print materials from the Site for your own non-commercial reference or for bona fide trade-account activity (for example, printing a tasting note to accompany a wine list). You may not reproduce, republish, modify, sell, or commercially exploit Site content without prior written permission.

6. Brand assets and producer materials

Vine Talker PDFs, shelf talkers, tech sheets, tasting notes, producer logos, and bottle photography are made available on the Site to support legitimate trade marketing, staff training, menu development, and consumer education.

By downloading these materials, you agree to use them in a manner consistent with the producer's brand guidelines and applicable alcoholic-beverage advertising laws, including TTB advertising rules and any state-level requirements. You will not alter the materials in a way that is misleading about the product, producer, or Baobab Wines.

7. Third-party websites and resources

The Site contains links to third-party websites (producer sites, news coverage, social media). These links are provided for convenience. We do not control and are not responsible for the content, privacy practices, or availability of any third-party site. Accessing third-party sites is at your own risk.

8. Submissions and communications

If you send us a message through the Site's contact forms, subscribe to our newsletter, or otherwise communicate with us, we will use your information to respond to your inquiry and — with your consent where required — to send you relevant portfolio and trade updates.

Our handling of personal information is described in our Privacy Policy. Please do not send us ideas, suggestions, or materials that you consider confidential or proprietary; we do not accept unsolicited proposals.

9. Prohibited conduct

You agree not to use the Site in a manner that is unlawful or that could harm the Site, its users, or Baobab Wines. In particular, you may not: (a) access the Site if you are under the legal drinking age in your jurisdiction; (b) attempt to interfere with the operation of the Site or probe it for vulnerabilities; (c) scrape or mass-download Site content; (d) use Site content in marketing that violates applicable alcoholic-beverage advertising laws; or (e) misrepresent your identity or licensing status when making a trade inquiry.

10. Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, BAOBAB WINES DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF INFORMATION.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the Site is at your own risk.

Nothing on the Site constitutes medical, nutritional, or health advice regarding the consumption of alcoholic beverages. Drink responsibly and in accordance with applicable health guidance.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BAOBAB WINES AND ITS OFFICERS, EMPLOYEES, AGENTS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SITE.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SITE IS LIMITED TO ONE HUNDRED US DOLLARS (US $100.00) OR THE TOTAL AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

12. Indemnification

You agree to defend, indemnify, and hold harmless Baobab Wines and its officers, employees, and agents from any claim, liability, loss, or expense (including reasonable attorneys' fees) arising out of your violation of these Terms, your misuse of the Site, or your violation of any law or the rights of a third party.

13. Governing law and venue

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Boulder County, Colorado, and you consent to the jurisdiction and venue of those courts.

14. Changes to these Terms

We may revise these Terms at our discretion. The "Effective" date at the top of the page will reflect the most recent version. Any material change that affects your rights will be communicated reasonably in advance where practicable, for example via an update on the Site or a notification to subscribed contacts.

15. Severability and entire agreement

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full effect. These Terms, together with the Privacy Policy and any other notices on the Site, constitute the entire agreement between you and Baobab Wines concerning your use of the Site and supersede any prior understandings or agreements relating to that subject matter.
